CHS makes its paper and digital navigational charts and publications available to the public through its extensive dealer network.

There are two options available to you for selling and licensing CHS navigational products: a dealer licence or a super-dealer licence. Dealers sell directly to end users while super-dealers manage their own dealer network.

Dealers

Sell CHS paper and digital charts and publications

Dealers participating in CHS’ world-wide dealer network have entered into licence agreements with CHS to sell CHS paper charts and publications, Electronic Navigational Charts (ENCs) in the S-57 format, and Raster Navigational Charts (RNCs) in the BSB format. ENCs and RNCs are sold individually and in pre-packaged geographic collections.

Retail prices for paper products are set by the Nautical Charts and Related Publications Fees Order SOR/94-281 and dealers must sell at these prices. Retail prices for digital products are suggested only, and dealers may set the final selling price. Royalties are then charged to the dealers as a percentage of the suggested retail price. The dealer then sublicenses the digital products to end users under the terms of the CHS End User Licence Agreement for CHS digital charts.

A dealer may also offer a digital chart updating service to its customers, or customers may acquire their chart updates from CHS directly. A dealer may also create and distribute System ENCs (SENCs). A dealer is not permitted to change the products other than to create SENCs. Dealers may bundle CHS digital products with other products.

Super-Dealers

A super-dealer is an organization that operates its own dealer network. A super-dealer enters into a super-dealer license agreement with CHS and acquires digital and paper charts and publications from CHS for distribution to its own dealer network.

Value-Added Resellers

Value-Added Resellers

CHS has many license agreements in place with Value-Added Resellers. The VAR program allows CHS to join forces with forward-thinking and innovative developers who use CHS products and data to develop new and creative products.

VAR products do not meet the chart carriage and use requirements of the Canada Shipping Act (Charts and Nautical Publications Regulations 1995) and the Arctic Waters Pollution Prevention Act because they are not official products issued by CHS. VAR products must carry a disclaimer to this effect.

Value-Added Resellers can enter into either a digital or a paper license agreement with CHS. When applying for a license for new products, VARs must demonstrate significant value-adding properties. Application forms are available below and questions can be directed to chsinfo@dfo-mpo.gc.ca.

Digital Value-Added Resellers

CHS charges an access royalty of $300 per licence term (BSB raster charts, S-57 vector charts, Tide and Current Products and/or Data, Sailing Directions Products and/or Data) plus sales royalties of 18% multiplied by the content ratio, of net sales by VARs. VARs are not permitted to digitize CHS paper charts; however they may be given permission to create a vector version of specific geographic areas if this does not already exist. VAR products are retailed directly by the VAR and/or by their own dealers.

Digital VAR licenses are valid for three years.

Paper Value-Added Resellers

CHS charges an access royalty of $300 per licence term (BSB raster charts, S-57 vector charts, Tide and Current Products and/or Data, Sailing Directions Products and/or Data) plus a sales royalty of 18% of the actual selling price of the VAR paper product, multiplied by the content ratio of products sold by the licensee containing CHS chart data.

Paper VAR licenses are valid for three years.

CHS has agreements in place with a wide range of specific users who rely on the quality and breadth of CHS data, surveys and products. CHS is pleased to offer a variety of copyright licences to support the activities of a wide variety of individuals and companies who wish to make use of Crown intellectual property managed by CHS:

Non-Commercial, Not-For-Navigation Users

A Letter of Permission ("LOP") is used to grant access to CHS charts or data for a specific purpose that is non-navigation, where there is no commercial product creation, and no revenues being generated. For example, an LOP would be used when there is a request to use a chart in a film. Royalties may or may not be charged, depending on the situation and which data is being requested.

Research and Commercial End Use

Private sector companies and researchers, students, charities, not-for-profit organizations, universities, Crown corporations (which are not agents of the Crown), provincial government agencies, municipalities and port authorities wishing to use CHS products or data may enter into a Direct User licence Agreement (DULA) with CHS. The products and data may not be further distributed. If the goal is to create a product to generate revenue, a value-added reseller licence agreement is more appropriate than a DULA.

End Users

CHS digital dealers have the right to grant sub-licences for CHS digital products to end-users for specified purposes, primarily navigation. End-users are required to agree to the terms and conditions of CHS's End-User License Agreement ("EULA"). End-users have no rights to further distribution of their CHS products. Users must acquire the appropriate licence from CHS for uses that fall outside the terms of their end-user licence. The CHS EULA limits customer to one installation of the data plus one backup on a device owned by the customer; or in the case of a ship using ECDIS, the installation limit is 5 stations.

Multiple Users

If a business requires a CHS digital product for multiple users, it can enter into a Site licence Agreement ("SLA"). The SLA is intended for a business which requires server-based access for a number of workstations in one or more corporate locations. Royalty rates are $25/paper chart equivalent/year, including updates with the royalty rate reduced based on the number of seats licenced. For example:

Collaborative Agreement with the Private Sector

CHS enters into collaborative arrangements with non-government entities for a variety of projects involving CHS surveys, data and products. The participants carry out activities jointly; share authority, decision making, effort, and responsibilities, both contribute resources for the purposes of achieving common goals, and both benefit from the joint activity.

The activity must be within the Department of Fisheries and Oceans' mandate, and be consistent with public policy and the strategic direction of the department.

Collaborative arrangements must comply with all Treasury Board and DFO policies in effect. There is no standard agreement for collaborative arrangements at this time.

Other Government Departments

When another government department makes a simple request for CHS data or products, it enters into a standard memorandum of understand ("MOU") with CHS. CHS recovers its incremental costs.

More complex arrangements with other government departments or other governments may be the subject of a negotiated MOU or treaty.
